Creator Agreement
Takes effect November 5, 2026
What's changing in the Creator Agreement on November 5, 2026:
- Written feedback on every review. Passes use three short boxes, or two when the pass is purely about fit. Accepts and place-elsewhere use one (Section 4).
- A new curator score and new Level cutoffs. Section 3.5 explains what goes into the curator score. Rating bonus amounts are unchanged, but most curators will be at a lower Level.
- Written expiry rules. These cover when we warn you, when we pause your curator access, what a pause covers, how to appeal, and probation after reinstatement (Section 4.1). The pause rules already apply from October 21, 2026 under the current agreement.
- Guidelines and standards for every curator. Aim for 85% thumbs-up from artists. Feedback should be respectful, written for the song and never repeated. Keep Magic Nothing pitches on Magic Nothing. We explain what we may do if reviews fall short, which can be immediate for serious breaches (Section 4, and Section 14.1 of the Terms). The full feedback guidelines are on their own page.
- Tokens earned by breaking the rules can be held while we look into it, or forfeited (Section 3.6).
- One clear rule for changes. Anything that could lower your pay per review, or add to what you have to do, gets 30 days' email notice. Other changes get at least 15 days (Sections 3.4 and 13).
- How this agreement starts. It starts when you first import a playlist or review a submission, and it has a written process for future updates (Sections 11 and 13).
Changes to the Terms of Service for curators, also on November 5, 2026:
- Some serious review breaches can lead to action without a warning first (Section 14.1).
- A pause of curator access is a suspension of curator access only. Your account stays open (Sections 14.2 and 14.3).
- Written feedback on every review, and what stays up to you as an independent curator (Sections 4.2, 8.1, 8.2 and 8.3).
1. Introduction
This Creator Agreement ("Agreement") governs the relationship between Magic Nothing Inc ("Magic Nothing," "Platform," "we," "us") and playlist curators ("Creator," "Curator," "you") who earn revenue by reviewing music submissions on the Platform.
This Agreement supplements our Terms of Service, which also apply to you. In the event of a conflict between this Agreement and the Terms of Service, this Agreement controls for curator-specific matters.
2. Creator Eligibility
- You must be at least 18 years old
- You must have the legal right to enter into this Agreement
- You must provide accurate information on the Platform
- You must maintain the quality standards set by the Platform
3. Revenue Sharing
3.1 Curator Earnings: Quality-Based Payouts
Your earnings are based on your playlist quality tier, which rewards curators who deliver value to artists. Higher-tier playlists earn a larger share of submission revenue. Current rates for each tier are displayed on the Platform.
Your quality tier is determined by playlist performance metrics. Details on how quality tiers are calculated are available on the Platform.
Earnings are calculated in real-time and added to your account.
3.2 Cashout Policy
- Minimum cashout: as displayed on the Platform
- Cashouts processed within the timeframe displayed on the Platform
- 1 token = $1 USD for cashout purposes
- Payment methods: as available on the Platform (currently Stripe Connect)
- Platform may require tax information before processing payments
- If fewer than 5% of your reviews are accepts once you've done at least 20 reviews, your cashouts go to a person to approve instead of going out automatically. They're never blocked for this. While we look into a possible breach, including under Section 3.6, we may also send your automatic cashouts for a manual check before they're paid. The cashout page tells you when either applies. A pause for expired submissions never holds your cashouts.
3.3 Earning Events
You earn tokens when you review a submission (accept, pass, or place elsewhere). You do not earn tokens for submissions that expire without review or that you choose to refund.
3.4 Changes to Rates, Tiers and Levels
We may change payout rates (including the rating bonus paid at higher curator Levels), quality tier thresholds, how your curator score is calculated, Level cutoffs, and platform fees. If a change could lower your pay per review, including your Level or rating bonus, we'll email you at least 30 days before it takes effect. Other changes follow Section 13. Either way, a submission always pays the rate that was locked in when the artist submitted it.
3.5 Curator Score and Levels
Your curator score runs from 0 to 100. In order of weight, it's built from: finishing your reviews rather than letting submissions expire, how quickly you respond, how many reviews you've done in the last 90 days, and your placement rate. Artist ratings of your feedback can lower your score. You get a score after your first 10 reviews, and the current weights are shown on the Platform.
Your score sets your Level. Levels 4 and 5 earn a rating bonus on each review. Your score also affects how submissions are matched to your playlists. Matching also depends on genre fit, your playlist's tier and price, and what the artist asks for. You move up a Level as soon as your score reaches its cutoff, and you keep a Level until your score falls 3 or more points below that Level's cutoff. Current cutoffs and bonus amounts are shown on the Platform.
If you run a playlist for someone else, its reviews, ratings and expiries count toward your score, not the owner's.
3.6 Tokens Earned by Breaking the Rules
Tokens earned through activity that breaks this Agreement or the Terms of Service aren't owed to you and may be forfeited. That includes fake reviews, reviews of songs you didn't listen to, reviewing your own submissions, running more than one account, and artificial playlist activity. This applies whether or not we also pause or end your curator access. While we look into activity like this, your cashouts go to a person to approve instead of being paid automatically, and we may hold back the tokens we reasonably believe were earned this way until we decide. We'll tell you in writing when we do this, and we'll pay the rest of your balance as normal. If we forfeit tokens, we'll tell you which ones and why, and you can appeal within 30 days by emailing info@magicnothing.com. If tokens earned this way were already cashed out, we may deduct them from your balance.
4. Curator Obligations
As a playlist curator, you agree to:
- Respond to every submission within the review window displayed on the Platform, by accepting it, passing on it, placing it elsewhere or refunding it.
- Write feedback on every review, passes included. Feedback should be respectful, written for that song, show that you listened to it, and not repeat what you've written for other songs.
- Keep Magic Nothing pitches on Magic Nothing. Don't accept payment outside the Platform for placing a song that was pitched to you here, and don't ask an artist who pitched you here to pay you, contact you, or pitch you somewhere else instead. Sharing the link to your public playlist is fine.
- Maintain accurate playlist information and genres.
This Agreement isn't exclusive. You're free to curate on other platforms and anywhere else, and if an artist finds you somewhere else on their own, that's between the two of you. What you can't do is use Magic Nothing to meet artists and then take them elsewhere. The contact details and other information you get from submissions are covered by Section 10, which continues after this Agreement ends.
Guidelines. We also ask every curator to:
- Aim for at least 85% thumbs-up from artists, both on your feedback and on your placements. This is a guideline: missing it on its own isn't a breach of this Agreement.
- Keep expired submissions rare. Section 4.1 sets out when we warn you and when we pause your curator access.
Artist ratings feed your curator score (Section 3.5).
When reviews fall short. A person on our team reads your recent reviews against this section when fewer than 75% of the ratings on your pass feedback are thumbs-up (over at least 20 ratings), when an artist raises a concern, or when we spot a problem ourselves. A low thumbs-up rate is a reason for us to look. On its own, it's never a reason to act. If we find reviews that break the standards in this section, we'll check in with you or send a formal warning first, and we may pause your curator access if it carries on.
Serious breaches. We may pause your curator access straight away, without a warning first, for any of these:
- feedback that insults, mocks, threatens or demeans the artist, or is discriminatory
- feedback that clearly shows the song wasn't listened to, for example describing sounds, lyrics or a genre that aren't in it, naming the wrong song, or writing something so generic it could apply to any song, more than once
- asking an artist to pay you, to deal with you off the Platform, or to pitch you somewhere else instead
Fraud, harassment and the other severe violations listed in Section 14.1 of the Terms of Service can also lead to immediate action.
Pausing to protect artists. We may also pause your curator access straight away where we reasonably believe it's necessary to protect artists, other users or the Platform, including for conduct this section doesn't specifically list, for example suspected fraud or account takeover, a credible report of harassment, or a security problem. A pause is reversible, and we'll tell you why when we act. When we've finished looking into it, we'll tell you what we've decided, and either restore your access or give you notice under this section. While we look into a matter, your cashouts go to a person to approve instead of being paid automatically (Section 3.6).
Ending curator access. We may end your curator access for good under Section 7 straight away for fraud, or for repeated breaches, including a second pause during probation (Section 4.1). In any other case, including a single serious breach, ending your curator access takes effect 30 days after we tell you, and your access stays paused in the meantime. Missing the 85% guideline on its own is never a reason to pause or end your curator access. Ending curator access doesn't close your account. "Repeated breaches" means a breach of this Agreement after we've already warned you in writing, or paused your curator access, for the same or a similar breach, or a final pause during probation under Section 4.1.
Reasons and appeals. When we act, we'll tell you in writing, before or at the time it takes effect: what we did, which reviews or events it's based on, and which part of this Agreement they break (or, for a pause to protect artists, why we believe it's necessary). You can appeal within 30 days by emailing info@magicnothing.com. A person reads every appeal, and we handle appeals as soon as we can.
At your request, our team can assign another curator to run one of your playlists for you (delegation). Our team sets this up; it isn't a self-serve feature. You stay responsible for the playlist itself: its content and its accuracy. The delegate is responsible for their own reviews under this Agreement. While a playlist is delegated, its reviews, ratings and expiries count toward the delegate's curator score and standing under Section 4.1, not yours. If we find a delegation was set up to get around these rules, we may count the delegate's reviews and expiries as yours, and we may end the delegation. If a delegate's curator access is paused, the delegation ends and the playlist comes back to you, switched off for submissions until you turn it back on. If your own curator access is paused, playlists you've delegated keep running with the delegate.
You may turn on vacation mode to stop new submissions to your playlists for a while. It refunds anything waiting, and it never counts as an expiry.
4.1 Expired Submissions
When a submission expires, the artist gets their tokens back and you aren't paid for it. We'll email you about it within a day. This section covers submissions to your playlists and to your personal curator queue. Editorial reviews aren't covered.
An expired submission on its own isn't a breach of this Agreement. Expiries are handled only under this section: they can lead to a warning or a pause, and they can end your curator access only through a final pause during probation.
- New curators: if the first of your first 3 submissions expires, we'll send you a warning. If all 3 expire, we pause your curator access.
- Everyone else: we'll send a formal warning if 3 submissions in a row expire over 2 or more days, or if more than 7% of your finished submissions expire. We pause your curator access if 5 submissions in a row expire over 2 or more days, or if more than 10% of your finished submissions expire. "In a row" means with no review in between, so one review breaks a streak. "Finished" means you reviewed it, refunded it, or it expired. The percentages look at the last 90 days, but never before October 21, 2026 or before the date you were reinstated, and they only apply once you have at least 20 finished submissions in that time. The same start dates apply to formal warnings and to pauses.
- Warning first, then a second check. We never pause your curator access under this section without a formal warning first, based on the same count. For new curators, that's the warning after your first expiry. If you go straight past a warning line to a pause line, you get the warning first. There are always at least 24 hours between the warning and a pause. When the 24 hours are up, we check again, and the pause only goes ahead if you're still over the pause line. Warnings sent before October 21, 2026, or before a reinstatement, don't count toward this.
- What doesn't count: an expiry we mark as caused by a problem on our side, and refunds because the artist cancelled, because a submission was released in error, because you turned on vacation mode, or because of a pause. These don't count as expiries or as finished submissions.
- Vacation mode is for real breaks. Taking a break is fine, and we'd rather you turn vacation mode on than let songs expire. But switching it on again and again just before songs would expire, to avoid the expiry rules rather than to take a break, is a breach of this Agreement. We handle it under the manual-action rules in Section 4: we'll check in or warn you first, tell you in writing what we've seen, and you can appeal.
- Delegated playlists: expiries count against whoever runs the playlist. If someone runs a playlist for you, its expiries count toward their warnings and pauses, not yours.
- Start dates: for a pause, we only count expiries on or after October 21, 2026. After a reinstatement, we only count expiries from the reinstatement date.
What a pause covers. A pause covers all of your curator access: the playlists you run yourself, your personal queue, and any playlist you run for someone else. While you're paused, you can't add playlists, run anyone else's, or switch your playlists or queue back on. A playlist of yours that someone else runs for you under Section 4 keeps running with them while you're paused. Songs waiting on your own playlists and queue are refunded to the artists. If you run a playlist for someone else, that delegation ends, and the playlist goes back to its owner, switched off for submissions, with any waiting songs.
Your balance. You keep your earned balance and can still cash it out. A pause for expired submissions never holds your cashouts or takes tokens away. Section 3.6 still applies to tokens earned by breaking the rules. Your account stays open. A pause is a suspension of curator access under Section 14.2 of the Terms of Service, not a termination under Section 11.
Appeals and coming back. You can appeal any pause within 30 days by emailing info@magicnothing.com, as set out in Section 14.6 of the Terms of Service. A person reads every appeal, and we handle appeals as soon as we can. After 30 days you can still ask to come back, but reinstatement is then at our discretion. If we reinstate you:
- your playlists come back switched off for submissions until you turn them back on
- your counts start again from that day
- you're on probation for 90 days
During probation the rules in this section apply as normal. But if your curator access is paused again during those 90 days, under this section or for a breach under Section 4, that pause is final unless we decide otherwise after reviewing an appeal. A final pause ends your curator access under Section 7 (see Section 11). After a final pause, you can't curate on Magic Nothing again, on this account or any other, unless we agree in writing.
5. Stripe Connect & Payouts
- To receive payouts, you must complete Stripe Connect onboarding, including identity verification and tax information as required by Stripe and applicable law.
- Payouts are processed in USD. If your Stripe Connect account is in another currency, Stripe will convert at their prevailing exchange rate.
- Magic Nothing does not have access to your banking details. These are handled entirely by Stripe.
- If your Stripe Connect account is restricted or closed by Stripe, we cannot process payouts until the issue is resolved with Stripe directly.
6. Content Standards
- All content must be original or properly licensed
- Content must be appropriate and professional
- No misleading or false information
- Must comply with all applicable laws
7. Platform Rights
The Platform reserves the right to:
- Review and approve curators and playlists
- Monitor creator performance and user feedback
- Pause curator access as described in Sections 4 and 4.1, and end curator access straight away for fraud or repeated breaches of this Agreement, or otherwise 30 days after we tell you, as described in Section 4
- Change quality tier thresholds, curator score formulas, Level cutoffs and payout rates, as described in Section 3.4
- Remove content that violates our policies
8. Intellectual Property
- You retain ownership of your original content
- You grant the Platform a limited, non-exclusive license to display and promote your content on the Platform
- You warrant that your content doesn't infringe on others' rights
- The Platform owns all Platform-related intellectual property and branding
9. Taxes
- You are solely responsible for reporting and paying all taxes on earnings from the Platform.
- Magic Nothing will issue IRS Form 1099 (or equivalent) as required by applicable law for US-based creators.
- For creators outside the US, you are responsible for compliance with your local tax obligations. Magic Nothing may request tax documentation (e.g., W-8BEN) before processing payouts.
- If required by law, Magic Nothing may withhold taxes from your payouts.
- You must provide accurate tax information when requested.
10. Confidentiality
In the course of reviewing submissions, you will have access to artist information including their music, messages, and Spotify data. You agree to treat this information as confidential.
- You may not share, publish, or disclose submission details, artist messages, or feedback outside the Platform without the artist's consent.
- You may not use artist data obtained through submissions for any purpose other than reviewing and responding to submissions on the Platform.
This obligation survives termination of this Agreement.
11. Term and Termination
- This Agreement begins when you first import a playlist or review a submission as a curator. The current version applies, as updated under Section 13.
- You can end this Agreement whenever you like by stopping curating and telling us. We may end it with 30 days' written notice, or straight away for fraud or repeated breaches as described in Sections 4 and 4.1. A no-fault notice doesn't pause your curator access: you can keep curating until it takes effect.
- Upon termination, earned tokens above the cashout minimum will be paid out within 30 days, subject to completion of Stripe Connect onboarding and applicable tax documentation.
- Tokens earned through activity that broke this Agreement or the Terms of Service may be forfeited, as set out in Section 3.6.
- If your curator access is paused during probation under Section 4.1 and not restored on appeal, that ends your curator access under Section 7 for repeated breach of this Agreement. It is not a notice termination under this Section. You can still cash out your earned balance from your profile. If you haven't within 30 days, we'll pay out what's left, including a balance under the cashout minimum, once your payout details and tax information are set up.
- Ending your curator access doesn't close your account. You can keep using Magic Nothing as an artist.
Survival. The following sections survive termination: Tokens Earned by Breaking the Rules (Section 3.6), Intellectual Property (Section 8), Taxes (Section 9), Confidentiality (Section 10), and Dispute Resolution (Section 12).
12. Dispute Resolution
Any disputes arising from or relating to this Agreement will be resolved in accordance with the Dispute Resolution provisions in our Terms of Service (Section 18), which are incorporated by reference.
13. General Provisions
- This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Magic Nothing regarding your role as a curator.
- Amendments must be in writing.
- We may update this Agreement. We'll email you about a change at least 15 days before it takes effect, and at least 30 days before if it could lower your pay per review (including your Level or rating bonus) or add to what you're required to do. We'll only make a change sooner where the law requires it or to deal with fraud or a security problem, and we'll tell you why. Corrections that don't change anyone's rights, like fixing a typo or a link, are posted with a new "Last updated" date. You can stop curating before a change takes effect, and it won't apply to you. You'll be asked to accept updated versions on the Platform. If you keep reviewing submissions after a change takes effect, that also means you accept it.
- If any provision is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
- This Agreement is governed by the laws of the State of California, without regard to conflict of law principles.
